The President and Council of the Law Society of Kenya have turned President William Ruto’s offer of appointment to a taskforce to audit the national debt. The offer, made via a gazette Notice No. 8261 of 2024, was termed as “Unconstitutional and an effort by the President to usurp the constitutional role of other bodies through Executive orders.
The LSK reminded the President that the role of auditing the national debt is vested in the Office of the Auditor General, currently occupied by Nancy Gathungu, under Article 229 (4) of the Constitution. Under the article, the Auditor General is required to audit national institutions within six months of the end of Financial Year.
The LSK also advised the President not to squander public resources in appointing taskforces when there were Constitutional bodies established to undertake those functions.
Earlier, THEDISPATCH.DIGITAL reported that some members of the LSK had urged their President not to accept the appointment to the taskforce as it would compromise the role if the LSK as a protector of the public interest. Its President, Ms. Faith Odhiambo, has earned national prominence through her recent activities of fighting for the freedom of arrested demonstrators and asserting their tight to picket.
