Court to Rule on Whether Businessman Will Face Charges in Sh50 Million Land Fraud Case

A Nairobi court will rule on September 2 whether businessman Howard Mugambi Mururu will face charges for allegedly defrauding former Lands boss and ex-Baringo MP Sammy Komen Mwaita of a piece of land valued at Sh50 million. Milimani Chief Magistrate Susan Shitubi ordered Mururu to appear in court for the ruling.

Mururu, a Nairobi-based businessman, had been brought to court on Tuesday, where he was set to be charged with fraud. However, his lawyer, Joseph Mutava, a former judge, argued that the matter was still under consideration by the High Court, with unresolved issues surrounding the ownership and legitimacy of the land title.

The court was informed that the legitimacy of the title deed was still being contested in a civil court. According to documents presented in court, Mururu is accused of conspiring with others not before the court to defraud Mwaita by falsely claiming that his company, Mart Properties—a fraudulently registered entity—was the legitimate owner of the land in question.

Additionally, Mururu faces a separate charge of obtaining registration by false pretense. It is alleged that on December 17, 2021, at Ardhi House in Nairobi, he fraudulently transferred the land from Mart Properties to himself, fully aware that the transaction was based on false pretenses.
