The High Court has dismissed former Murang’a Governor Mwangi Wa Iria’s petition challenging the Director of Public Prosecutions’ (DPP) decision to have him and others charged in the Anti-Corruption Court. The prosecution, represented by Ms. Keli, Mr. Panyako, Mr. Momanyi, Mr. Walusala, and Mr. Mwasaru, opposed Wa Iria’s petition with detailed submissions.

Justice P.J. Otieno of Nairobi’s Anti-Corruption & Economic Crimes Division ruled that the court could not interfere with the DPP’s constitutional powers under Article 157. The issues raised by Wa Iria and the other petitioners were deemed matters for the trial court to address. Consequently, the petition was dismissed with costs.

Wa Iria and nine others face charges of unlawfully awarding a media services contract to Top Image Media Consultant Limited, valued at over KES 543 million. The case will be mentioned on October 3, 2024.

Residents of Khwisero sub-county have called on local police to investigate a widow named Deborah Mwanika Omoto, accusing her of double-selling land in the Wambulishe sub-location of Kisa West, Kakamega County. Allegedly, Omoto, who resides near COTU Secretary-General Francis Atwoli’s ancestral home in Bukwala village, has been exploiting her son’s incarceration to manipulate land buyers.

Her son is currently serving a prison sentence at Shikuse Maximum Prison for murder, and she has reportedly used this misfortune to solicit funds by claiming she needed money to reduce his sentence to manslaughter. According to several victims, after selling the land, she later retracts, citing family opposition, and promises to refund the money, which often leads to confrontations.

At least 10 people, including a teacher and an administrator, are lining up to file complaints against her, hoping police will recover their money. When contacted, Omoto admitted to selling the land under pressure due to legal issues surrounding her other son, but pledged to eventually repay those involved.

Local police are expected to investigate the claims further as more victims step forward.

The incident, which took place on the evening of August 28, has sent shockwaves across the church and community, as police intensify efforts to locate him.

The abduction was first alerted by the bishop himself, who sent a distress message to his driver, Felix, at 6:11 PM. In his message, Bishop Lihanda warned that his life was in imminent danger. After receiving the alarming message, Felix attempted to reach out to the bishop, but his calls went unanswered, and all of the bishop’s phones were switched off.

Fearing the worst, Felix quickly reported the incident to Gambogi Police Station. The local Deputy OCS took immediate charge of the case and began an investigation.

The administrator revealed that the bishop was last seen driving a white Mercedes Benz with the registration number KBW 547X, and the disappearance has been recorded at Mbale Police Station under OB number 30/28/9/2024.

The administrator urged the public to refrain from making speculative comments that might further distress the bishop’s family during this challenging time. He also called on PAG worshippers to join in prayers for Bishop Lihanda’s safe return.

Shabana FC Fights Back in Court After Fan Ban Over Ulinzi Stadium Violence

Shabana Football Club has taken its battle to the courts, filing an urgent appeal before the Sports Disputes Tribunal (SDT) to overturn a ban imposed by the Football Kenya Federation (FKF). The club’s legal team is pushing back against accusations that their supporters were involved in the violence and destruction of property during last weekend’s match at Ulinzi Complex Stadium in Nairobi.

The chaos that erupted at the stadium has landed Shabana FC in hot water, with FKF slapping a five-match ban on the club’s supporters. If upheld, the ruling will prevent fans from attending home games, a move that Shabana’s lawyers argue will cripple the club financially.

Speaking at a press conference in Nairobi, a team of city lawyers – Danstan Omari, Shadrack Wambui, Sam Nyaberi, and Paul Macharia – came out swinging, arguing that Shabana FC stands to lose millions in revenue from the absence of their loyal fanbase.

Omari made it clear that there is no direct evidence linking Shabana’s supporters to the damage at the stadium. “Not a single piece of CCTV footage or witness statement shows that Shabana fans were responsible,” he said, adding that Ulinzi Stars fans could just as easily have been behind the chaos.

“This decision is overly harsh,” Omari continued. “None of the Shabana fans were given a chance to defend themselves, and there seems to be a plot to stifle the talent coming out of Gusii land.”

The legal team also highlighted the significant economic impact the ban would have on the local community. “Hotels are fully booked ahead of the return match in Gusii, and small businesses like mama mbogas and those selling bananas will lose big if the fans are kept away, especially those travelling from the city,” Omari said.

The lawyers are now calling for intervention from President William Ruto, Sports Cabinet Secretary Kipchumba Murkomen, and Gusii leaders to step in and prevent what they describe as an unfair attack on the club. Omari hinted that powerful forces, whom he referred to as “cartels,” are behind the move to weaken Shabana FC.

The heated clash between Ulinzi Stars and Shabana FC ended in a 2-2 draw, but the fallout has been explosive. Yesterday, FKF chairman Michael Majua issued a directive banning Shabana fans for five matches and ordering the club to cover all medical expenses for officers injured in the fracas.

The club’s supporters now await the tribunal’s decision, hoping that justice will be served and they will be allowed back into the stands to cheer on their team.

Fraudster Posing as Nairobi County Official Arrested, KFS Officers Busted in Shocking Bribery Scandal

A suspected fraudster posing as a senior Nairobi County official has been arrested in a sting operation by the Ethics and Anti-Corruption Commission (EACC), alongside two Kenya Forest Service (KFS) officers caught running a separate bribery racket in Garissa.

Nairobi County Imposter Nabbed

In the heart of Nairobi’s Central Business District, a man identified as William Otieno Okoth was apprehended after he allegedly demanded a Kes100,000 bribe from a complainant, falsely claiming he could secure a job for the complainant’s wife as a cleaner in the Nairobi City County Government. Posing as the Personal Assistant to the County Secretary, Okoth convinced the victim that his influence within the County was substantial and that a “tea” payment of Kes100,000 would fast-track the issuance of an employment letter.

The desperate complainant, however, saw through the scam and reported the matter to the EACC, which promptly set up a trap. Okoth was arrested red-handed as he collected the bribe outside Trattoria Restaurant in the CBD. Following the arrest, the suspect was processed at Integrity Centre Police Station before being detained at Kilimani Police Station. He now faces further interrogation and formal charges for impersonation and bribery.

Kenya Forest Service Officers in Bribery Bust

In a separate but equally shocking development, two Kenya Forest Service (KFS) officers have been arrested in Garissa for orchestrating a fraudulent scheme targeting casual workers. The two suspects, Elphas Tembu Wesonga, a Conservator, and Ibrahim Aden Hussein, an Accountant, were found to be exploiting KFS employees by overpaying them and then demanding that they return the excess funds for personal gain.

The officers allegedly deposited inflated salaries into the bank accounts of casual employees, disguised as legitimate payments. Once the funds were withdrawn by the workers, the officers would force them to hand over the money. During the operation, EACC officers recovered Kes73,000, part of that day’s illicit collection, believed to be destined for the pockets of the suspects and their superiors.

Both Wesonga and Hussein were processed at the EACC North Eastern Regional Offices in Garissa before being booked at Garissa Police Station for further questioning and potential charges.

Four Suspects Arrested in Shocking Abduction and Homo-Sexual Assault of Blogger Chawa-001

 

FOUR SUSPECTS ARRESTED IN SHOCKING ABDUCTION AND SEXUAL ASSAULT OF BLOGGER CHAWA-001

In a stunning turn of events, four suspects have been arrested in connection with the abduction and sexual assault of controversial Mombasa blogger Bruce John Kajira, also known as Chawa-001. The brutal incident, which has shocked the country, took place on 12th September 2024, when Kajira was violently abducted and subjected to a horrifying attack.

The suspects, identified as Abdul Hassan Athman, who was found with the motorcycle believed to have been used in the abduction, Esther Muthoni, Violet Adera, and Haji Babu Ndau Mohamed alias JAY, were apprehended after a nationwide manhunt. Mohamed, a boda boda operator who transported the victim, was nabbed in Athi River while attempting to flee on a Dreamline bus.

A HORRIFIC ORDEAL

Kajira, known for his outspoken social media posts, was reportedly accosted by a gang of over 10 individuals at his Bamburi Mwisho home. The attackers, riding motorbikes, broke into his residence under the pretext of taking him to apologise to the Mombasa Governor for allegedly slandering the official and his family on social media. Once abducted, Kajira was taken to an unknown location where he was gang-raped and assaulted.

Investigations reveal that the attackers were in constant communication with planners who provided financial support and guided the brutal act. After the assault, the gang dumped Kajira in a thicket, bound in a sack and unconscious. He later regained consciousness and was rescued by a good Samaritan who helped him return home. Kajira was initially denied treatment at Coast General and Referral Hospital but later admitted to Beyond Scope Hospital in Kisauni.

ARRESTS AND CHARGES

Following an intensive investigation by the DCI Operations Support Unit and DCI Coast, the four suspects were arrested and charged in Shanzu Law Court No. 4 with serious offences, including conspiracy to commit a felony, abduction with intent to confine, gang rape, and assault causing actual bodily harm. They have pleaded not guilty to the charges and are currently remanded at Shimo la Tewa Prison, awaiting the court’s ruling on their application for bond or bail on 26th September 2024.

The investigation is ongoing, with authorities expecting to make more arrests. Senior officials from the Mombasa County Government have also been summoned for questioning, as they are believed to have collaborated with the perpetrators. The DCI is determined to uncover their roles in this shocking case and bring them to justice.
